1. Scope of Application

These Terms and Conditions apply to all services offered on the platform Next-Gen-Digital (www.next-gen-digital.de).

These terms apply equally to all users – both clients and freelancers.

2. Service Description

Next-Gen-Digital is an online marketplace for digital freelance services, including but not limited to design, development, marketing, translation, content creation, audio/video, data and AI.

The platform provides the technical infrastructure for collaboration but does not offer its own services or act as a contractor.

3. Registration and Accounts

Registration is free of charge.
Only legally competent individuals and legal entities are eligible to register.
Users must provide accurate and complete information.
Multiple registrations per person are not permitted.
Accounts may be suspended or deleted in case of policy violations.

4. Contracts Between Users

All service agreements are concluded directly between the client and the freelancer.
Next-Gen-Digital is not a contracting party and only facilitates the initiation, communication, and payment process.

5. User Obligations

Users agree to:
– Not offer or request illegal content or services
– Not bypass the platform (e.g. via external payments)
– Respect copyright and intellectual property rights
– Keep private communications confidential

6. Payment Processing

Payments are processed securely via Stripe and PayPal.
Billing is handled automatically through the platform.

7. Fees and Commissions

Registration is free.
Next-Gen-Digital charges a platform commission per transaction.
The fee is shown transparently at checkout.

8. Reviews

Users can leave reviews after order completion.
Reviews must be honest, factual, and must not violate the rights of others.
Next-Gen-Digital reserves the right to remove unlawful or abusive content.

10. Limitation of Liability

Next-Gen-Digital is not liable for any services provided by users or external tools.
Liability is only assumed for damages caused intentionally or through gross negligence.

11. Termination

User contracts are open-ended.
Users may delete their accounts at any time.
The platform reserves the right to terminate accounts without notice if the terms are violated.

12. Changes to These Terms

We may amend these terms at any time.
Users will be notified via email or platform notification.
Changes will be deemed accepted unless objected to within 14 days.

13. Jurisdiction and Applicable Law

Place of jurisdiction is Karlsruhe, Germany (where legally permissible).
German law applies.
The contract language is German.
